The court ruled 4-3 that the Superior-based Catholic Charities Bureau and its subentities' motivation to help older, disabled and low-income people stems from Catholic teachings but that its actual work is secular. Every Catholic diocese in Wisconsin has a Catholic Charities entity that serves as that diocese's social ministry arm. The Catholic Charities Bureau is the Superior diocese's entity. “The majority’s misinterpretation also excessively entangles the government in spiritual affairs, requiring courts to determine what religious practices are sufficiently religious under the majority’s unconstitutional test,” Rebecca Bradley wrote. “The majority says secular entities provide charitable services, so such activities aren’t religious at all, even when performed by Catholic Charities.”

CNN —The policy-making body of the federal judiciary is clamping down on the system that conservatives have successfully used in recent years to hamstring President Joe Biden’s agenda and other federal policies, including those concerning reproductive rights. The new policy seeks to curb “judge-shopping,” the strategy where litigants strategically file lawsuits in courthouses where the cases will be guaranteed to be heard by judges perceived to be sympathetic to their arguments. While the strategy has long been used in patent cases, there been a concerted uptick for politically charged, wide-reaching cases that have been filed in Texas by Republican state attorneys general or conservative, private-sector parties. Under the new policy, such cases seeking nationwide or state-wide orders will go into the lottery system used by the entire district. “The current issue relates to nationwide injunctions or statewide injunctions,” Sutton said at a news conference Tuesday.

Oklahoma's Republican Attorney General Gentner Drummond on Friday sued to stop a state board from establishing and funding what would be the nation's first religious public charter school after the board ignored Drummond's warning that it would violate both the state and U.S. constitutions. Drummond filed the lawsuit with the Oklahoma Supreme Court against the Oklahoma Statewide Virtual Charter School Board after three of the board's members this week signed a contract for the St. Isidore of Seville Catholic Virtual Charter School, which is sponsored by the Archdiocese of Oklahoma City. The school board voted 3-2 in June to approve the Catholic Archdiocese's application to establish the online public charter school, which would be open to students across the state in kindergarten through grade 12. A message left Friday with Rebecca Wilkinson, the executive director of the Oklahoma Statewide Virtual Charter School Board, was not immediately returned, although Wilkinson has said previously she wouldn't comment on pending litigation. The National Alliance for Public Charter Schools, a nonprofit organization that supports the public charter school movement, released a statement Friday in support of Drummond's challenge.

CNN —Justice Clarence Thomas disclosed Thursday that Republican megadonor Harlan Crow paid for private jet trips for Thomas in 2022 to attend a speech in Texas and a vacation at Crow’s luxurious New York estate, as ethics questions continue to rock the Supreme Court. Thomas made the disclosures after receiving an extension to file the yearly reports that were originally due in May 2023. In a statement after the ProPublica report, Thomas acknowledged the friendship but stressed that Crow did not have business before the court. In addition, he said that he should have disclosed a 2014 private real estate deal between Crow, Thomas and members of Thomas’ family. According to the disclosure, Thomas flew down to be the keynote speaker of the event in February, but returned via private jet “due to an unexpected ice storm.”The talk was rescheduled in May and Thomas rode round trip on Crow’s plane.

July 31 (Reuters) - The American Civil Liberties Union (ACLU) filed a lawsuit on Monday on behalf of Oklahoma residents asking a state judge to block the creation of the nation's first religious public charter school. Oklahoma's Statewide Virtual Charter School Board, one of the defendants in the suit, in June approved the Catholic Church's application to create the St. Isidore of Seville Catholic Virtual School, which would use millions of dollars in taxpayer funds to operate. Rebecca Wilkinson, the executive director of the statewide virtual charter school board, said in an email that the agency would not comment on pending litigation. Charter schools are publicly funded and independently run under the terms of a charter with a local or national authority. Listed as plaintiffs in the lawsuit challenging St. Isidore are nine Oklahoma residents and the Oklahoma Parent Legislative Action Committee.

To the Editor:Having read The Times’s reporting on the Supreme Court’s decision on affirmative action and another essentially authorizing discrimination under the guise of religious liberty, I have a message for Chief Justice John Roberts. I have been a member of the Supreme Court Bar for 25 years. I joined the Bar because I was appointed to represent a prisoner seeking to address the court. It was a proud moment, because I was doing my duty, and had reverence for the institution. I have worked too hard and long to be sullied by an association with such disregard for the law and ethics.
